These Terms of Service (“Terms”) govern your use of pawkoda.com and purchases from PawKoda. By visiting our website, creating an account, or placing an order, you agree to these Terms and the policies linked on our store. If you do not agree, do not use the website.

1. About our store

PawKoda operates this online store using Shopify. References to “PawKoda,” “we,” “us,” and “our” mean PawKoda. References to “you” mean a visitor, customer, or other user of the store.

2. Eligibility and account responsibility

You must be at least the age of majority in your province or territory to make a purchase, or have permission from a parent or legal guardian. You are responsible for keeping account credentials secure and for activity conducted through your account. Information submitted to us must be current, complete, and accurate.

3. Products and pet safety

We make reasonable efforts to display product descriptions, colours, dimensions, materials, and images accurately. Screen settings and manufacturing changes may cause minor differences. Read the product page, sizing information, warnings, and care instructions before use.

Pet products must be selected for the individual animal and used under appropriate supervision. Inspect products regularly and stop use if an item is damaged, no longer fits correctly, or creates a risk. Unless a product page expressly states otherwise, our products are not professional veterinary, restraint, safety, or life-saving devices. Contact a veterinarian or qualified professional when advice is needed.

4. Prices and availability

Prices, promotions, product availability, and descriptions may change without notice before an order is accepted. Canadian checkout prices are shown in Canadian dollars (CAD) unless another currency is clearly displayed. Applicable taxes, discounts, shipping charges, and the final total appear before payment.

5. Orders

Submitting an order is an offer to purchase. An automated confirmation means we received the order; it does not guarantee acceptance. We may refuse, limit, or cancel an order for reasons including unavailable inventory, inaccurate product or pricing information, suspected fraud, payment issues, resale activity, or delivery restrictions. If we cancel after payment, we will refund the amount charged for the cancelled item.

6. Payment

You authorize PawKoda and its payment providers to charge the payment method selected at checkout. Payments are governed by our Payment Policy. You agree to provide accurate billing information and to pay all charges shown before submitting the order.

7. Shipping and delivery

Processing times, delivery estimates, tracking, destinations, and shipping costs are described in our Shipping Policy. Delivery dates are estimates unless we expressly state otherwise. Risk of loss transfers as provided by applicable law. You are responsible for providing a complete and accurate delivery address.

8. Returns, refunds, and cancellations

Returns, refund eligibility, return shipping, damaged or incorrect items, exchanges, and cancellation requests are governed by our Return and Refund Policy. Nothing in these Terms limits a mandatory consumer right that cannot legally be excluded.

9. Acceptable use

You may not use the website or its content to violate law, infringe intellectual-property or privacy rights, submit false information, transmit malicious code, interfere with security, scrape or collect information without authorization, impersonate another person, send spam, or engage in fraudulent, abusive, or harmful activity. We may suspend access or cancel affected orders where reasonably necessary.

The PawKoda name, website design, written content, graphics, logos, photographs, videos, and other store materials are owned by or licensed to PawKoda and are protected by applicable intellectual-property laws. You may use the website for personal, non-commercial shopping only. No content may be copied, republished, sold, or exploited without prior written permission, except as permitted by law.

11. Reviews and submissions

If you submit a review, photo, suggestion, or other content, you confirm that you have the right to share it and that it is accurate, lawful, and does not violate another person’s rights. You grant PawKoda a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt, and display that content for operating and promoting the store. We may remove submissions that violate these Terms.

12. Third-party services and links

Our store may use or link to third-party services, including Shopify, payment providers, carriers, social platforms, and external websites. We do not control third-party sites and are not responsible for their content, availability, security, or practices. Your use of those services may be subject to separate terms and policies.

13. Errors and changes

Occasionally the website may contain typographical errors, inaccuracies, or omissions relating to descriptions, pricing, promotions, shipping, or availability. We may correct errors and update information. If a correction materially affects an order already placed, we will contact you where reasonably required and apply applicable law.

14. Disclaimer

To the maximum extent permitted by law, the website and its content are provided on an “as available” basis. We do not promise that access will always be uninterrupted, timely, secure, or error-free. Products are subject only to warranties expressly stated on the product page and warranties that cannot legally be excluded.

15. Limitation of liability

To the maximum extent permitted by law, PawKoda will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website or products. Our total liability for a claim related to a purchase will not exceed the amount paid for the product giving rise to the claim. These limits do not apply where prohibited by law, including liability that cannot legally be limited.

16. Indemnity

To the extent permitted by law, you agree to indemnify PawKoda against third-party claims, losses, and reasonable costs arising from your unlawful misuse of the website, your breach of these Terms, or your infringement of another person’s rights.

17. Severability and waiver

If any provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A delay in enforcing a provision is not a waiver of that provision.

18. Governing law

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles. Courts located in Ontario will have jurisdiction, subject to any mandatory consumer rights that allow you to bring a claim elsewhere.

19. Changes to these Terms

We may update these Terms by posting a revised version with a new “Last updated” date. Changes apply prospectively from the date posted. Continued use of the store after an update means you accept the revised Terms.
